What Are the Legalities of SMS Appointment Reminders in GoHighLevel Software?

By | July 19, 2023

**Question around legalities for SMS appointment reminders:**

Are SMS appointment reminders in a workflow considered telephone solicitation? Technically, they opted-in and displayed written consent that they want to be opted in, does the texting time windows still apply?

Does anyone know the answer to this?

Here's what the TCPA says:

The TCPA stipulates telephone solicitation (including text messages) may not occur anytime before 8 a.m. or after 9 p.m. in the recipient's time zone, but certain states are more restrictive.

Florida, Oklahoma, and Washington state laws impose stricter requirements that dictate texts can only be sent between the hours of 8 a.m. and 8 p.m. in the recipient's local time zone.

To avoid risk, marketers should only send texts between 9 a.m. and 8 p.m. and ensure time zones are respected.

**Are SMS appointment reminders in a workflow considered telephone solicitation?**

A member of the GoHighLevel Official Facebook group recently asked whether SMS appointment reminders in a workflow can be considered telephone solicitation. The TCPA (Telephone Consumer Protection Act) states that telephone solicitation, including text messages, should not occur before 8 a.m. or after 9 p.m. in the recipient's time zone. However, some states like Florida, Oklahoma, and Washington have stricter requirements that limit text messages to be sent only between 8 a.m. and 8 p.m. in the recipient's local time zone.

When it comes to GoHighLevel software, it is important to be aware of these legal restrictions. If you are using the platform to send SMS appointment reminders, it is crucial to ensure that you are sending them within the permitted time frames according to the TCPA and any additional restrictions imposed by the recipient's state laws. Failure to comply with these regulations can result in legal consequences.

While GoHighLevel software provides tools for sending SMS appointment reminders, it is ultimately the responsibility of the user to ensure compliance with applicable laws and regulations. We recommend familiarizing yourself with the specific regulations in your jurisdiction and consulting legal professionals to ensure compliance.

Hi Isabella Bedoya That is a great question. I was told that it isn’t solicitation IF they opted-in and displayed written consent that they want to be opted in. However, I would contact the company that you are using their Texting software. ASk them as there are new rules that just came out.
